Terms & Conditions

Please read this carefully because it sets out the terms of a legally binding agreement between you and Dubai Consultancy Research & Media Centre herein referred to as b’huth.
These are the terms and conditions on which you may use the b’huth website and  the content/services available (which we call ”b’huth Content”). The b’huth website may be accessed from the following URLs: DubaiConsultancy.com, DubaiConsultancy.ae, DCRMC.com, DCRMC.ae, bhuth.com or bhuth.ae.  These URLs all point to a single website, known here as bhuth.ae or as a b’huth website. These terms apply equally to the above named URL’s and to your use of any of them to reach b’huth Content irrespective of the delivery platform or device you use to access it. By accessing a b’huth website, you are agreeing to these terms and conditions. If you use a b’huth website  in the course of your business or work, you are also agreeing to these terms and conditions on behalf of that business.
If you do not agree with the terms and conditions (or are not authorised to do so on behalf of your business or work) you should not use bhuth.ae. bhuth.com or any b’huth Content . If you have any questions please contact editor@bhuth.ae.
Except where we state references in these terms and conditions to ”b’huth” (or ”we”, ”us” or ”our”) refer to the company operating b’huth.ae. See Section 9 below for details.

1. Introduction
These terms and conditions were last updated on 5 March 2010 and replace all previous terms and conditions for bhuth.ae or bhuth.com. b’huth may update these terms and conditions for legal or regulatory reasons, or to reflect changes in our services or business practices. We may in exceptional circumstances cease to publish b’huth. The b’huth Content or cease to provide subscription services. If we do so, then we will have no further obligation to you, unless you are a subscriber in which case we will offer you a refund of the unexpired period of your subscription. See Section 7 for details.
2. Access and Use
The amount of b’huth Content that you can view on bhuth.ae depends on what type of user you are.  In summary: if you are an unregistered user, you can view  articles outside of the subscriber area, but may not comment on them.  A  registered user may submit comments on articles which may or may not be published at the discretion of our editors.  From time to time we may invite specific  users to register as experts.  Registered experts may publish comments directly to  the forum areas without editorial intervention.  We may also invite certain users to access sections of bhuth.ae which may be the same as or different from the access given to registered experts or subscribers. 
Permitted Use:
All b’huth Content belongs to b’huth or has been licensed to b’huth and we  own the  intellectual property rights (including copyright and database rights) to the b’huth Content and any selection or arrangement of the b’huth Content . ”b’huth” and ”Dubai Consultancy Research and Media Centre” are registered in  the United Arab Emirates and you may not use them without written permission from b’huth.
You can do the following:
• view b’huth Content on any client device that is compatible with b’huth.ae (this might be your PC, laptop, Blackberry, iPhone or other mobile device) and store b’huth Content on that single device
• share links to articles outside the subscriber area.
• publish online:  headline links and the first paragraph of an article  or what we call the teaser, or forward it to other individuals, provided you attribute the content to b’huth and the individual author. 
• republish extracts from b’huth articles on an occasional basis as part of your own original work so long as you  attribute the extract to b’huth (including the named author) and provide a link back (online use) or reference (offline use) to the original article. By “extract” we mean a small proportion of the article. By “occasional”, we mean that you are republishing extracts from fewer than ten b’huth articles a month.
• republish a full article so long as you obtain permission to do so and attribute the article to b’huth and the individual author. 
• use technology to search and link to bhuth.ae, provided that you do not infringe the Restrictions on Use below.
Restrictions on Use:
You cannot use bhuth.ae or the b’huth Content for any unlawful purpose or any purpose other than as set out in the “Permitted Use” section above,
 By way of example, this means that you cannot:
• share your b’huth user name and password with anyone else.
•  copy, publish, republish or redistribute full-text articles except as noted in the “Permitted Use” section.
• copy, publish, republish or redistribute extracts except as permitted by the “Permitted Use” section above.
• archive or store b’huth Content for any use except as described  in the “Permitted Use” section above.
• create summaries, abstracts or other derivative works from the b’huth Content, except as permitted in the “Permitted Use” section above.
• remove the copyright notice from any copies of b’huth Content made under these terms and conditions.
• use technology to frame, harvest or scrape the b’huth Content  and/or create a database in electronic or structured manual form by systematically and/or regularly downloading, caching, printing and storing b’huth Content
• use or attempt to use the b’huth Content beyond the parameters we set depending on what subscription you have,
Linking: If you would like to link to bhuth.ae, please read and comply with the following guidelines and all applicable laws. A site or service that links to bhuth.ae:
• may, with permission, display the b’huth logo but must not otherwise use any b’huth trade marks
• may not remove, distort or otherwise alter the appearance of the b’huth logo;
• may link to the homepage of bhuth.ae, and, provided that the requirements of Section 2 are complied with, may also link to other pages of bhuth.ae;
• must not in any way imply that b’huth is endorsing it or its products or services;
• must not misrepresent its relationship with b’huth or present false information about b’huth;

3. Privacy Policy and Registration
All information received by you from your use of bhuth.ae will be used by b’huth in accordance with our Privacy Policy which binds us to keep your personal information secure and not share it with any third party.  
On registration, you must provide b’huth with accurate, complete registration information and it is your responsibility to update and maintain changes to that information on the applicable bhuth.ae registration or subscription pages. b’huth is entitled to rely on any information you provide to us.
Each registration is for a single user only. On registration, you will choose a user name and password (”ID”). You are not allowed to share your ID or give access to b’huth Content through your ID to anyone else. You are responsible for all use of b’huth.ae made by you or anyone else using your ID and for preventing unauthorised use of your ID.  
If you provide b’huth with an email address that will result in any messages b’huth may send you being sent to you via a network or device operated or owned by a third party (e.g. your employer or college) then you promise that you are entitled to receive those messages. You also agree that b’huth may stop sending messages to you without notifying you
4. User Generated Content
bhuth.ae publishes articles, forums and comments  that allow interaction among users and between users and b’huth. We call the information contributed to bhuth.ae  to be  “User Generated Content” or “UGC”.
When you  submit an article or a comment for bhuth.ae then you agree to comply with any specific rules posted on the website, and we  are under no obligation to publish the UGC you submit.  You will retain ownership of the copyright to any of your UGC that you or we publish on bhuth.ae so you are free to re-use it as you wish. You agree that when you submit UGC to b’huth,  you are granting b’huth a license to this content  unlimited in time to publish, re-use, archive, modify, delete or commercially exploit that UGC in whole or in part as we see fit, whether on bhuth.ae or otherwise, without any requirement to pay you for this and with or without attribution to you. This means that you grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free licence to use any UGC  in whole or in part in any manner and for any purpose whatsoever and without further obligation to you. 
You are responsible for all the content of any of your UGC that you or we publish. You are financially responsible to us for any claim against us by any third party: that your UGC is not in accordance with the bullet points below or that otherwise relates to your UGC.
You agree that you will:
• only publish UGC that is your original content and will not infringe the copyright or other rights of any third party when publishing UGC.
• not post, link to or otherwise publish any UGC containing any form of advertising or promotion for goods and services or any spam or other form of unsolicited communication.
• not post, link to or otherwise publish any UGC that is threatening, abusive, libelous, indecent or otherwise unlawful.in the United Arab Emirates.
• not disguise the origin of any UGC and not impersonate any person or entity (including b’huth employees or Forum guests or hosts) or misrepresent any connection with any person or entity.
• not post or otherwise publish any UGC unrelated to the Forum or the Forum’s topic.
• not post or transmit any UGC that contains software viruses, files or code designed to interrupt, destroy or limit the functionality of bhuth.ae or any computer software or equipment.
• not collect or store other users’ personal data.
• not restrict or inhibit any other user from using the Forums.
By selecting experts who may post to our Forum and by reviewing comments by other users before posting, b’huth exercises editorial judgment regarding UGC.  Nevertheless it is not possible to guarantee fully the accuracy, integrity or quality of any UGC. If some user does post UGC that is misleading, untrue or offensive and  where we have actually received notice of any UGC that is potentially misleading, untrue, offensive, unlawful, infringes third party rights or is potentially in breach of these terms and conditions, then we will review that UGC, decide whether to remove it from bhuth.ae and act accordingly. If you believe that any UGC published on bhuth.ae infringes any legal rights that you may have or is not allowed under these terms and conditions, please notify us immediately with specific details by contacting us at editor@bhuth.ae .
5. Our Responsibilities To You
A summary of what this section means: this section is important and you should read it carefully. It makes clear to what extent, if any, b’huth accepts responsibility (liability) to you for your use of bhuth.ae or the b’huth Content.  Unless you are a subscriber to bhuth.ae, we accept no financial responsibility to you arising from your use of bhuth.ae or the b’huth Content. If you are a subscriber to bhuth.ae, we limit our financial responsibility to you arising from your use of bhuth.ae or the b’huth Content to the price you paid for your subscription. In no circumstances do we accept responsibility for your use of Third Party Sites or in respect of any Third Party Products.
Limitations of b’huth Content: the b’huth Content (including any information we publish regarding Third Party Products) is only for your general information purposes. In particular, the b’huth Content, including UGC and any other content provided by third parties and distributed by bhuth.ae, does not constitute any form of advice, recommendation, representation, endorsement or arrangement by b’huth. It is not intended to be and should not be relied upon by users in making (or refraining from making) any specific investment, purchase, sale or other decisions. Any information that you receive via bhuth.ae, whether or not it is classified as ”real time”, may have stopped being current by the time it reaches you.
6. Subscription Services
We offer subscription services through bhuth.ae and recommend that you read the subscriptions details document before purchasing a subscription. When you purchase a subscription to use bhuth.ae then your usage rights will be limited as set out in the subscription details. 
Contract formation: b’huth will try to process your subscription promptly but does not guarantee that your subscription will be activated by any specified time. By submitting your payment and other subscription details, you are making an offer to us to buy a subscription. Your offer will only be accepted by us and a contract formed when b’huth provides access and the payment has been made.  b’huth reserves the right to reject any offer in its discretion, for any or no reason.
Payment details: when you subscribe you must provide us with complete and accurate payment information. By submitting credit card payment details you promise that you are entitled to purchase a subscription using those payment details. If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your access to your subscription and may in suspicious circumstances contact the issuing bank and/or law enforcement authorities/other appropriate third parties. If you are entitled to a refund under these terms and conditions we will credit that refund to the card you used to submit payment, unless it has expired in which case we will contact you. If you buy a subscription using a corporate credit card than we will treat your subscription as being for the benefit of both you and the relevant company.
Pricing: the subscription price will be made clear to you on our subscription pages or otherwise during the subscription process and may vary from time to time or by country. You agree to pay the fees at the rates notified to you at the time you take out your subscription and using the online process available.
Other costs: in addition to any subscription fees you pay, you are responsible for paying any internet connection or other telecommunications charges that you may incur by accessing bhuth.ae or using the services available on it. For example, if you use any of our mobile services then your network operator may charge you for data or messaging services.
Free trials: we may from time to time and at our discretion make a free trial available to users, in which case we will only charge you for your subscription with effect from the expiry of the free trial period.
Renewals: if you chose to pay monthly, your subscription will continue until you tell us that you no longer wish to receive it, in which case you will stop paying the monthly fees. Please see the “Cancellations by you” section below for details of how to cancel your monthly subscription. If you chose to pay annually, we will send you an email letting you know when your annual subscription is close to ending (unless you have already told us that you wish to cancel your subscription).
Cancellations by you and refunds: You may notify us of your wish to cancel your subscription by contacting our Customer Services team at editor@bhuth.ae. We will refund a proportional amount of your subscription remaining based on the date the subscription started and the date we receive your request for cancellation.  Refunds will only be made to the credit card or bank account that was used to pay for the subscription.
Cancellations by us: b’huth reserves the right to suspend or terminate your subscription if you breach these terms and conditions, with or without notice and without further obligation to you. You will not be entitled to any refund in these circumstances. If however we terminate or suspend your subscription for any other reason and/or permanently cease publishing bhuth.ae, the b’huth Content or cease to provide subscription services then, unless there are exceptional circumstances, we will provide you with a pro rata refund which means that we will refund you with any amounts that you have paid us in advance that relate to any remaining and unexpired period of your subscription. These terms and conditions apply for the benefit for any or all of the above entities who may rely on them and/or enforce them in their own right.
7. Choice of Law and Jurisdiction
For the exclusive benefit of b’huth, b'huth will retain the right to bring or enforce proceedings as to the substance of the matter in the courts of the United Arab Emirates. 
8. General
You may not license or transfer any of your rights under these terms and conditions. We may transfer any of our rights or obligations under these terms and conditions to any company within the Dubai Consultancy Research & Media Centre but if we do so we will ensure that any company to whom we transfer our rights or obligations will continue to honour your rights under them.
If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which will remain in full force and effect.
Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.
bhuth.ae is best viewed with a current version of the Internet Explorer browser.  Any payment information you send to us over the Internet is encrypted using Secure Socket Layer technology currently the preferred method to securely transfer credit card data over the Internet.
9. Corporate Information
Dubai Consultancy Research & Media Centre is the publisher of the bhuth.ae website, and its corporate details are as follows: registered postal address is P.O box 57578, Dubai, UAE; company offices are in SIT tower, Silicon Oasis.  
10. Changes to Terms and Conditions
These terms and conditions were published on 5 March 2010  and replace with immediate effect and terms and conditions previously published. 

 11. Discussion Group

All discussions are open for user’s viewing, however participation and contribution to some discussions may be on an invitation basis only as determined by b’huth’s editorial team.

By taking part in the discussion the participant agrees that commentary and contributions made will come under b’huth ownership and hence b’huth copyright. B’huth reserves the right to use commentary from discussion in other material in different formats, including but not limited to the development of written articles, infographics and newsletter highlights, without the need to notify original author of the relevant commentary.  

B’huth moderates the discussion and reserves the right to remove commentary it judges offensive, or finds that it does not abide with UAE media and copyright laws.

B’huth requests from participants to respect international and UAE copyright law, please include references when referring to external material.

Comments made by participants, including b’huth experts, are the sole opinion of the author and do not represent the opinion of b’huth.
